TRONDHEIM, Norway – Electromagnetic Geoservices (EMGS) has entered an agreement with PGS to settle the two companies’ patent disputes.
In December 2013,EMGS filed a complaint against PGS in the UK’s High Court of Justice, Chancery Division, Patents Court.
The complaint alleged that PGS had infringed EMGS’ European patent EP 1256019 (Refracted Wave Patent).
In April 2014, EMGS also initiated proceedings in Oslo City Court in Norway relating to PGS’ towed streamer EM (electromagnetic) technology, for what it claimed was an infringement of EMGS’ parallel Norwegian patent, NO 324 454.
Last March, PGS EM responded by filing a complaint against EMGS in the US District Court for the District of Delaware.
This alleged that EMGS’ survey activities in theGulf of Mexico and on the US outer continental shelf, the company’s interactions with US customers and its importation of certain data products into the US, infringed a PGS-owned US patent, “Detection of Subsurface Resistivity Contrasts with Application to Location of Fluids.”
All the disputes have now been settled. The agreement grants PGS a license to the EMGS patent for operation of its towed streamer EM system, while EMGS has similarly been granted a license to the PGS patent.
The terms also open the path to joint EM and seismic surveys between the two companies in future.
